For the modern and developed state an actual problem is protection of non-material cultural heritage. Especially the problem of preservation of cultural heritage is particularly acute in China and Russia. The comparative analysis of legislations is an important step for the solution of these tasks. Detection of weaknesses of legislations, for the purpose of improvement of quality of protection and protection of non-material cultural heritage has to be the key moment of the analysis.
